General Release and Indemnification

Dear Artist,          The Walkers’ Gallery in the San Marcos Activity Center has continuously monitoring television cameras and staff on duty during all hours of operation as well as during special events. Work is stored prior and post exhibit in locked cabinets unless oversized. Work is handled, hung and, when necessary, shipped by experienced art curators and installers. All precautions and care will be taken to protect and ensure the safety of your artwork while it is in our possession. Patrons of the Activity Center greatly appreciate and respect the value of your work. The San Marcos Area Arts Council has insurance coverage for the stated value of artworks in the unlikely event of damage or theft. This form releases those mentioned from any liability beyond declared base value coverage of work while in the exhibit and care of agents of the San Marcos Arts Council.   This base liability extends from stated collection and return dates of the exhibit to which artwork has been entered. Artists are responsible for picking up their work on the stated date unless previous arrangements are made. All liability ends once the stated time for pick-up has been exceeded. The undersigned does for himself, herself, his and her heirs and assigns, hereby forever waive, release and discharge the San Marcos Area Arts Council, its officers and Board of Trustees, the San Marcos Parks and Recreation and the City of San Marcos, their members or agents, from any and all manners of actions, suits, damages, claims and demands whatsoever, in law and equity, for any loss or damage to the undersigned’s property, and for any personal liability. The undersigned acknowledges and agrees that neither the City nor its agents will provide any security or protection for entries and that their display will be at the sole risk of the submitter. In addition, the undersigned grants permission to the San Marcos Area Arts Council or its agents to photograph entries for use in show publicity and/or website exhibit representation.
